12 Tricks That Raise a Settlement Offer

Adjusters work from a range. These are the moves that shift where inside it your file lands.

Never accept the first offer

It is an opening position generated by software, not a valuation. Opening offers are routinely a fraction of what the same file settles for eight weeks later.

Do not give a recorded statement to the other insurer

You are obliged to cooperate with your own insurer, not with theirs. Early recorded statements are used to lock in a version of events before you know the full extent of your injuries.

Close every gap in treatment

Valuation software penalises breaks in care regardless of the reason. If you must miss appointments, have the reason documented in the medical record at the time.

Wait for maximum medical improvement

Settling before your condition stabilises means settling on incomplete information. The release is permanent; the injury may not be.

Send a demand package, not a phone call

A written demand with organised records, a damages schedule and a specific figure is handled differently from a call asking what they will pay.

Anchor high but defensibly

Ask above your target and show the arithmetic behind it. An anchor with no working behind it invites the adjuster to discard the whole demand.

Get the policy limits in writing early

Many states require disclosure on request. Knowing the ceiling tells you whether you are negotiating over value or over collectability.

Photograph everything on day one

Vehicle positions, the roadway, visible injuries, and the hazard itself. Once a scene is cleared it cannot be reconstructed, and photographs outrank recollection every time.

Keep a contemporaneous symptom diary

Dated entries about pain, sleep and missed activities support non-economic damages far better than a summary written months later.

Negotiate the liens before you sign

Health plans and providers routinely accept reduced repayment once a case resolves. That reduction often exceeds what another round of settlement negotiation would produce.

Check your own underinsured coverage

When the at-fault driver has minimum limits, your own policy is frequently the larger source of recovery. People forget they are insured against this.

Put the deadline in your calendar immediately

The statute of limitations is jurisdictional and unforgiving. Every other tactic on this list is worthless if the filing date passes.
